Legal Advisor in Judea and Samaria

The legal advisor to the territories of Judea and Samaria provides legal consultation for the chief of the central command and those forces which operate in the region.

Role and responsibilities

 

Within the framework of their undertakings, the department's officers provide legal advice for the operation of forces which operate in the area. These include all IDF forces operating in the area; the Samaria and Judea district police; the General Security Service and the various relevant governmental departments whose activities fall under the jurisdiction of the district.

The Judea and Samaria legal advice unit also provides legal advice in international law, public administrative law, local regulations and security legislation. The unit's officers provide legal opinions, draft proposed legislation for Judea and Samaria, and afford legal advice to state organs operating in the area. Additionally, it represents the military in Military tribunals and supervises the legality of the army's activities in Judea and Samaria.


Departments

 

The office of the legal advisor for Judea and Samaria is divided into five distinct departments. Each department is commanded by an officer holding the rank of Major:


1.    The Department of Crime and Security provides legal opinion relating to legislative initiatives regarding law enforcement, and is concurrently involved with monitoring legal aspects of security activities in the various demarcated areas.
2.    The Interior Department provides advice concerning planning and construction matters, in both the Israeli and Palestinian sectors as well as in the affairs of the local government and Israeli settlements.
3.    The Real Estate Department is responsible for advising on the legal status of various parcels of real estate in Judea and Samaria; expropriating real estate property for public use; and indemnity payments in consideration for the occupation of real estate under certain conditions.
4.    The Civilian and Economic Department provides advice relating to civilian legislation in the area; tort claims against the Ministry of Defense and the Commander of the IDF in the area, Public Tenders and issuing communication licenses.
5.    The Registrar's Department advises on legal issues concerning entry permits from Judea and Samaria to Israel, employment permits and family visitations.
