Administrative proceedings

 

Together with criminal prosecutions, the Prosecutor of Judea and Samaria represents the military commander in all proceedings that concern judicial review of military detention orders. Administrative detention orders in Judea and Samaria, are issued and subject to judicial review in accordance with the provisions of Article 78 of the Fourth Geneva Conventions (1949).

 

The administrative detention measure can be used only on an exceptional basis when the evidence in existence is clear, concrete and trustworthy, but for reasons of confidentiality and protection of intelligence sources, cannot be presented as evidence in ordinary criminal proceedings. It is important to clarify, that the administrative detention conforms with the principles of international humanitarian law.
